The Trump Administration Asks High Court Clearance for State Guard Personnel in Chicago Area

Legal Battle Over Guard Activation
In an immediate request, the justice department asked the bench to set aside a previous judicial decision that had stopped the deployment of several hundred state guard personnel to the Chicago area.
The presiding judge had expressed skepticism about the administration's justification for activating the guard, doubting its reasoning in given local conditions.
A higher court affirmed the initial ruling on Thursday, leaving the deployment on hold while the court case continues.
White House's Justifications
The top government lawyer, representing the government, wrote in the new filing that federal law enforcement have repeatedly been “intimidated and attacked” in Chicago and the outlying area of Broadview community.
This area is home to an Immigration and Customs Enforcement detention center.
The president has earlier dispatched national guard forces to Chicago, Illinois and the city of Portland, subsequent to earlier sendings to LA, the city of Memphis, and the nation's capital.
The president has argued that military intervention is necessary to reduce protests and strengthen deportation efforts.

At the core of the conflict is the administration's application of a national law authorizing the president to nationalize the national guard only in situations of uprising or when “powerless with the federal troops to execute the laws of the US”.
The government argues that the troops are essential to defend federal property and personnel from protesters.

Earlier this month, the administration nationalized 300 troops of the Illinois military reserve and directed additional guard from Texas forces into the region.
As local leaders criticized the decision, the former president escalated his rhetoric, calling on the detention of the city's leader and the governor of Illinois, the two Democratic officials, alleging them of not managing to protect ICE personnel.
Illinois and municipal government jointly sued the administration to stop the deployment.
On October 9, the presiding federal judge, appointed by Joe Biden, issued a preliminary order blocking the order.
